After the Grand Jury declined to indict police officer Darren Wilson in the shooting death of Michael Brown, the argument of transparency in Grand Jury proceedings was brought forth.  The Grand Jury is not new to the criminal justice system and has roots in early English Common Law.

In today's digital world and with the need for transparency in the criminal justice system, should Grand Jury proceedings be open to the public, similar to a criminal trial?

Students taking this course will explore the major tenants of the Fifth Amendment:

  • Right to a Grand Jury

  • Right Against Double Jeopardy

  • Right to Remain Silent

  • Right to Due Process

  • Eminent Domain
